The Service includes our website, dashboard, API integrations, and all related features and functionality.
You must be at least 13 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.
WirePulse Daily integrates with the TikTok API, including the Content Posting API and TikTok Login Kit. By authorizing WirePulse Daily to connect to your TikTok account, you:

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Five S LLC. AI-generated video content created by our platform for publication to your social media accounts is provided for your use under a limited, non-exclusive license.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FIVE S LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE. You agree to defend, indemnify, and hold harmless Five S LLC and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party right including intellectual property rights or privacy rights.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Texas, USA. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
